The OnlyMonkes name, logo, mascot, banana iconography, and App user interface design are the property of the OnlyMonkes team.
The App's source code, server code, and original artwork are protected by copyright laws and international treaties.
"Saga Monkes" NFT artwork displayed within the App is the property of its respective creators and rights holders. Display within the App is incidental to on-chain verification of holder identity and does not transfer or imply transfer of any rights.
Third-party trademarks, logos, and brand names referenced in the App (e.g., Solana, XMTP, Jupiter, LiveKit, Helius, Cloudinary) are the property of their respective owners.
License to End Users
End users receive a limited, revocable license to use the App as described in our Terms of Use. No rights to copy, redistribute, sublicense, or create derivative works of the App or its assets are granted.
DMCA — Reporting Copyright Infringement
OnlyMonkes respects the intellectual property rights of others. If you believe that material accessible through the App infringes your copyright, you may submit a notice in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
How to Submit a Notice
Send a written notice to our designated agent at Jumpstreet25@icloud.com with the subject line "DMCA Notice". Your notice must include:
A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Identification of the copyrighted work claimed to have been infringed.
Identification of the material that is claimed to be infringing, with sufficient detail to permit us to locate it (including, where applicable, a Solana transaction signature, XMTP message identifier, or NFT mint address).
Your contact information (name, address, telephone number, email).
A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on behalf of the owner.
Note: Because messages on the XMTP network are end-to-end encrypted and stored on a decentralized protocol, OnlyMonkes does not have the technical ability to remove individual messages from the network. We can, however, take action against repeat infringers within the App where feasible.
Counter-Notice
If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notice to Jumpstreet25@icloud.com containing:
Your physical or electronic signature.
Identification of the material that has been removed or to which access has been disabled, and the location at which it appeared before removal or disablement.
A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in your judicial district (or, if outside the United States, any judicial district in which OnlyMonkes may be found), and that you will accept service of process from the person who provided the original notice or an agent of that person.
Repeat Infringers
OnlyMonkes will, in appropriate circumstances and at its discretion, restrict or terminate access for users who are determined to be repeat infringers.
Misrepresentation
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages.
